1. Scope of Agreement

These Terms of Service govern all engagements between DesignCraftiX (82131 Birkenstraße 5, Gauting, Germany) and any client commissioning design, UX, or creative services. By submitting a project brief or making a payment, you agree to these terms.

2. Service Delivery

DesignCraftiX delivers design and UX services as described in individual Statements of Work (SOW). Timelines provided in proposals are estimates; actual delivery may vary based on project complexity and client responsiveness during review cycles.

3. Pricing & Payment

All prices are quoted in USD unless otherwise stated. Invoices are payable within 14 days of issuance. Late payments incur a 1.5% monthly surcharge. DesignCraftiX reserves the right to pause work on accounts overdue by more than 21 days.

4. Intellectual Property

Upon full payment, all intellectual property rights in deliverables (design files, source code, assets, and documentation) transfer irrevocably to the client. DesignCraftiX retains the right to display completed work in its portfolio unless the client objects in writing.

5. Client Responsibilities

The client is responsible for providing timely feedback, brand assets, and access to relevant platforms. Delays in client feedback may extend project timelines proportionally.

6. Limitation of Liability

DesignCraftiX's total liability under any engagement shall not exceed the total fees paid by the client for the specific service giving rise to the claim. We are not liable for indirect, consequential, or incidental damages.

7. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This obligation survives termination of the agreement for a period of 3 years.

8. Governing Law

These terms are governed by the laws of the Federal Republic of Germany. Disputes shall be resolved in the courts of Munich, Germany.

1. What Are Cookies

Cookies are small text files placed on your device by websites you visit. They help us understand how you interact with our platform and improve your experience.

2. Cookies We Use

We use only strictly necessary cookies:

• • cookie_accepted — Stores your cookie consent preference (localStorage). Expires after 365 days.
• • session_id — Maintains your session state during form submissions. Expires on browser close.

We do NOT use analytics, advertising, or tracking cookies. We do NOT use third-party tracking pixels or behavioral advertising tools.

3. Google Maps

Our contact page embeds a Google Maps iframe to display our office location. Google may set cookies when this iframe loads. You can prevent this by not interacting with the map. Please refer to Google's Privacy Policy for details on their data practices.

4. Managing Cookies

You can manage or delete cookies through your browser settings at any time. Disabling strictly necessary cookies may impair certain platform functionalities, such as remembering your consent preference.

5. Changes to This Policy

We may update this Cookie Policy to reflect changes in our practices or legal requirements. The revised policy will be posted on this page with an updated effective date.

1. Eligibility for Refund

Clients may request a full or partial refund under the following circumstances:

• • Cancellation before work has commenced: full refund of any advance payment.
• • Cancellation after work has commenced: refund proportional to undelivered milestones.
• • Service not delivered as described in the Statement of Work.

2. Refund Process

To request a refund, contact us at [email protected] with your project reference and reason for the refund request. We will respond within 5 business days with a resolution.

3. Non-Refundable Items

The following are non-refundable: (a) completed and delivered work that meets the agreed specifications, (b) third-party costs incurred on your behalf (e.g., stock licenses, hosting fees), and (c) work cancelled after final delivery approval.

4. Refund Method

Approved refunds are processed via the original payment method within 10 business days. For Stripe transactions, refunds are initiated directly through the Stripe dashboard.

5. Dispute Resolution

If you are dissatisfied with our refund decision, you may escalate the matter by contacting us in writing. We commit to good-faith mediation before any formal dispute proceedings.
